High Court judge Justice Edith Mushore has refused to grant an interdict to stop the MDC from holding their congress which starts this friday  saying the matter was not urgent.

MDC lawyer Thabani Mpofu confirmed the development.

“Yah it is true the matter has been dismissed as nit being urgent. So basically the congress goes ahead as planned,” Mpofu said.

An MDC member from Gokwe had dragged the party to the High Court demanding that the congress  was illegal and was using  wrong structures.

This followed a ruling by the same Mushore early  this month that Nelson Chamisa  was not the legitimate MDC leader as his appointment  to be the party’s  Vice President by the late MDC leader Morgan Tsvangirai was illegal.

The ruling  instructed that the party should go to an extraordinary using  2014 structures.

But the MDC has since appealed against the ruling at the Supreme Court.

Earlier on, the party’s spokesperson Jacob Mafume had told journalists that their congress was going ahead  despite the court challanges.
