MDC leader Nelson Chamisa has enagaged a top city advocate Thabani Mpofu to challenge a recent High Court ruling which stripped him of his seat.
Chamisa who was told by the High Court that he was no longer the MDC leader as his rise to the post was illegal, has instructed Mpofu -who represented him during the election petition challenge-to approach the Supreme Court so that the court ruling could be overturned.
“We have engaged Advocate Mpofu to deal with this,” Chamisa said on Sunday
According to MDC sources, the lawyers were last week busy going through Justice Edith Mushore ruling which stripped Chamisa his positions.
The rulling removed Chamisa from the leadership position and placed him as an ordinary national executive member.
The bid it appeal the ruling comes as Thokozani Khupe- the one who must take over as the MDC president has started a process to take over the party leadership and has announced that she wants to talk to Chamisa.
Also sources said Khupe and her lawyers want to approach the court to stop the MDC from holding the congress slated for Gweru in two weeks times until he complies with the High Court order.
“Yes we have been studying through the court ruling and we are ready to Challenge it. The moment we note the challenge at the Supreme Court, it suspends the High Court decision and makes the already announced congress to go ahead,” said Mpofu.
