Striking doctors,government in legal battle


Labour and Social Welfare minister Dr Sekai Irene Nzenza has issued a show cause order against striking medical personnel made up of junior resident medical doctors, senior resident medical doctors , house medical officers, senior house medical officers, junior registrars and senior registrars as a result of the collective job action they undertook.The order was issued on December 13  and a subsequent order on December 20.

The respondents argued that they were given short notice to appear before the Labour Court.

They also argued on the applicability of the labour act and that the show cause order stated that they were supposed to attend Labour Court on December 24 and by moving the date backwards to Friday (yesterday) their  rights in terms of the provisions of the constitution have been violated.

The medical personnel were represented by Munyaradzi Gwisai who argued that the matter be heard at the Concourt.

“These are employees governed by the State and Labour Act does not apply,” submitted Gwisai.

In terms of law, a minister is empowered to issue a ‘show cause order’ which sets aside a strike and refers the dispute for determination by a Labour Court judge.
